Terms of Service
Effective date: January 1, 2026
These Terms of Service (“Terms”) govern your access to and use of the Aurista website, account portal, licensing services, and related offerings (collectively, the “Services”) provided by Weaver Production Sound, LLC (“Company,” “we,” “us,” or “our”). By creating an account, downloading software, purchasing a subscription, or using the Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate registration information and to keep it current. We may suspend or terminate accounts that contain false information, are used fraudulently, or violate these Terms.
3. Subscriptions and Billing
- Aurista is offered on a subscription basis unless otherwise stated.
- Payments are processed through PayPal. By subscribing, you authorize recurring charges according to your selected plan.
- Subscriptions renew automatically until cancelled through PayPal or as otherwise described at checkout.
- Prices, plan features, and billing intervals may change for future renewal periods. We will provide reasonable notice before changes affect an active subscription.
- Except where required by law, fees are non-refundable once a billing period has begun.
- Trials, promotional codes, and welcome offers are limited as described at redemption and may not be transferred or reused.
4. License Grant
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Aurista software in accordance with the License Agreement. The software is licensed, not sold.
5. Acceptable Use
You agree not to:
- Use the Services in violation of applicable law or third-party rights.
- Share, resell, sublicense, or redistribute license keys, trials, or activation credentials except as expressly permitted.
- Attempt to bypass licensing, activation, subscription, or security controls.
- Reverse engineer, decompile, or disassemble the software except to the extent such restriction is prohibited by law.
- Interfere with or disrupt the Services, servers, or networks connected to the Services.
- Use the Services to transmit malware or engage in abusive, fraudulent, or harmful activity.
6. Intellectual Property
The Services, Aurista software, website content, trademarks, logos, documentation, and all related intellectual property are owned by Weaver Production Sound, LLC or its licensors and are protected by copyright, trademark, and other laws. No rights are granted except as expressly stated in these Terms and the License Agreement.
7. Your Content
You retain ownership of audio recordings, metadata, and other content you create with Aurista. You are solely responsible for your content, backups, compliance with production requirements, and any third-party rights related to your work.
8. Disclaimers
THE SERVICES AND SOFTWARE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEAVER PRODUCTION SOUND, LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR MEET YOUR PRODUCTION REQUIREMENTS.
Aurista is a software tool. You are responsible for verifying recording integrity, backup workflows, timecode accuracy, and suitability for your production environment.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEAVER PRODUCTION SOUND, LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, PRODUCTION TIME, OR BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
10. Indemnification
You agree to defend, indemnify, and hold harmless Weaver Production Sound, LLC and its officers, members, employees, and contractors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your content, your violation of these Terms, or your violation of any law or third-party rights.
11. Suspension and Termination
We may suspend or terminate your access to the Services immediately if you breach these Terms, fail to pay fees, engage in fraudulent activity, or if required by law or payment processor policy. Upon termination, your license to use the software ends except as required by applicable law. Sections that by their nature should survive termination will survive, including payment obligations, intellectual property, disclaimers, limitation of liability, and indemnification.
12. Changes to the Services or Terms
We may modify the Services or these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use after changes become effective constitutes acceptance. If you do not agree, you must stop using the Services and cancel your subscription.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Georgia, and you consent to personal jurisdiction in those courts.
14. General
- These Terms, together with the Privacy Policy and License Agreement, constitute the entire agreement between you and the Company regarding the Services.
- If any provision is held invalid, the remaining provisions remain in effect.
- Our failure to enforce a provision is not a waiver of our right to do so later.
- You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
