Effective date: August 1, 2026
This End User License Agreement (“EULA”) is a legal agreement between you (“Licensee” or “you”) and Weaver Production Sound, LLC (“Licensor,” “we,” “us,” or “our”) for the WavStripper software application, updates, documentation, and related materials (collectively, the “Software”). By installing, copying, or using the Software, you agree to this EULA. If you do not agree, do not install or use the Software.
Subject to your compliance with this EULA and our Terms of Service, Licensor grants you a limited, non-exclusive, revocable, royalty-free license to install and use the Software on macOS computers you own or control for your professional or personal production-sound activities.
Except as expressly permitted by law, you may not:
The Software is licensed, not sold. Licensor and its suppliers retain all right, title, and interest in and to the Software, including all copyrights, trademarks, trade secrets, patents, and other intellectual property rights. No rights are granted to you except as expressly set forth in this EULA.
You retain all rights to audio files, metadata, and other data you process with the Software. You are solely responsible for backups, storage media, file integrity, and verifying results before discarding originals. Licensor does not claim ownership of your files and does not routinely access them.
THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, FREE OF DATA LOSS, OR SUITABLE FOR ANY PARTICULAR PRODUCTION, BROADCAST, OR POST-PRODUCTION USE.
YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE SOFTWARE, INCLUDING WITHOUT LIMITATION RISK OF FILE CORRUPTION, DATA LOSS, INCORRECT TRACK REMOVAL, METADATA CHANGES, DOWNTIME, AND PRODUCTION DELAYS. YOU AGREE TO USE THE SOFTWARE ONLY AFTER ADEQUATE BACKUPS AND YOUR OWN VERIFICATION OF OUTPUTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO HOLD HARMLESS AND RELEASE LICENSOR AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, AND SUPPLIERS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LOSSES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS’ FEES) ARISING OUT OF OR RELATED TO YOUR INSTALLATION OR USE OF THE SOFTWARE, OR YOUR RELIANCE ON ANY OUTPUT IT PRODUCES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, RECORDINGS, PRODUCTION TIME, EQUIPMENT, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS EULA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR ACCEPTS NO LIABILITY AT ALL FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SOFTWARE OR THIS EULA, INCLUDING WITHOUT LIMITATION ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. IF APPLICABLE LAW DOES NOT ALLOW A COMPLETE EXCLUSION OF LIABILITY, THEN LICENSOR’S LIABILITY WILL BE LIMITED TO THE MINIMUM AMOUNT PERMITTED BY SUCH LAW, AND WHERE A COMPLETE EXCLUSION IS ALLOWED, LICENSOR’S LIABILITY WILL BE ZERO.
This EULA is governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles. Exclusive venue for disputes lies in the state or federal courts located in Georgia.
This EULA, together with the Terms of Service and Privacy Policy, constitutes the entire agreement regarding the Software and supersedes prior or contemporaneous understandings on the subject.
